GARY Withey and David Grier cleared of large scale fraud allegations

TWO men have been cleared of allegations that they participated in a large scale fraud involving Rangers Football Club.

 

Businessmen Gary Withey, 52, and David Grier, 55, will, at this point in time, not stand trial alongside former Rangers owner Craig Whyte, 45.

 

The development occurred following a two day hearing which ended late on Friday afternoon at the Court of Criminal Appeal in Edinburgh.

 

Scotland's most senior judge Lord Carloway sat with colleagues Lord Bracadale and Lord Menzies in court. They had heard submissions from Mr Withey and Mr Grier's legal teams.

 

The reasons for the judges's decision cannot be reported at this point in time for legal reasons.

 

Prosecutors had alleged that Mr Withey, Mr Grier and Mr Whyte participated in criminal behaviour during their involvement with the Glasgow side.

 

The three men became associated with Rangers following Sir David Murray's decision to sell Rangers in May 2011.

 

Mr Whyte, of Banks, Lancashire, was in charge when the club went into administration in February 2012. He was also in charge when the side's previous incarnation was liquidated in July 2012.

 

Mr Withey, of Woking, was a former partner at Collyer Bristow – the London based law firm who advised Mr Whyte during his takeover at Rangers.

 

Mr Grier, of London, worked for Duff and Phelps – the financial company which was appointed administrators of Rangers.

 

The hearing at the appeal court was sparked by a development at a procedural hearing at the High Court in Edinburgh last month.

 

After a legal matter arose during proceedings, Lord Bannatyne fixed a date for judges at the Court of Criminal Appeal in Edinburgh to consider the issue.

 

Prosecutors brought the appeal to the court earlier this week.

 

However, after hearing detailed submissions from the Crown and defence counsel, the judges decided that the appeal should be refused.

 

This means that there no charges at this point in time against Mr Grier and Mr Withey. However, prosecutors may decide to raise fresh proceedings against them in the future.

 

The Crown position is not known at this point in time. The case is next scheduled to call at the High Court in Glasgow on June 3 2016.

Not expecting anything from this case to tell the truth.

 

No confidence in the authorities to bring this to fruition.

 

kind of hoped we'd at least hear the truth/details of what wnet on during the trial

 

doesn't even look as if its going to get that far

 

whyte's living in belgravia and qualifies to pick up legal aid - this country's legal system isa mess.

We are supposed to focus on welfare junkies and immigrants gorging on our public services and cash #DailyMailetc

 

Don't mention the costs, losses and collatoral damage that comes from creative lawyers, tax advisors, accountants alongside fraudsters and supposedly respectable banks and corporations.

 

There is a general lack of accountability for 'the suits' that is hard-wired into the system.

Difficult to comment on the specifics re. Grier and Witney as there is no accompanying detail.

 

If Greir was unaware of what was going-on, I'll eat my bunnet.

Let's hope this is not the start of the whole case falling apart or deals being done ,in a week were Fred Goodwin was told he won't face charges for almost bringing a whole country to its knees .
