Furious Three Bears call in lawyers to block £10m crisis loan which would hand Mike Ashley security over Ibrox

RECORD Sport understands lawyers were called in to examine Ashley's latest power grab after it emerged that his move has left the Douglas Park consortium's rival bid dead in the water.

 

LAWYERS could today put a block on Mike Ashley’s proposal to gain security over Ibrox by loaning £10m to Rangers.

 

Record Sport understands a team of legal experts were last night examining Ashley’s latest power grab after it emerged that, as a result of his move, a rival funding offer from the Douglas Park consortium has been effectively killed stone dead. The Park group had been offering a sum of around £5m in emergency cash which they believe would have been enough to keep the club solvent until fresh funds could be raised in a new share issue.

 

That deal would have been secured against the club’s Murray Park training complex but that option was eliminated yesterday when Ashley served advance notices of security on both the stadium and the Auchenhowie HQ with the Register of Scotland.

 

As a result, no other party may secure loans against either of the club’s biggest assets for a period of 35 days - leaving Ashley’s latest package as the only option open to the board if they are to meet the next wage bill in less than a fortnight’s time.

 

Yesterday’s dramatic moves then, left Ashley in a position of exclusivity as the club’s bank of last resort.

 

But Park and his allies, George Letham and George Taylor, believe it may be open to a legal challenge. They believe the current board misinformed the Stock Exchange yesterday when they released a statement claiming that no decision had been taken on which of the two proposed funding packages they plan to accept.

 

That statement read: “The directors confirm that they are currently considering various proposals to secure the financial future of the club, however no decision has been made at this time.”

 

Park, Letham and Taylor are understood to be outraged both by Ashley’s move to torpedo their offer and by the official line from a board which, despite yesterday’s statement, knows their deal is now unable to be delivered.

 

Furious Rangers fans will tonight take to Edmiston Drive tonight to demand Ibrox is kept from Ashley as Dave King finally prepares to go nuclear.

 

The Union of Fans have organised a protest against the Sports Direct tycoon’s move and King has seen enough. He is now ready to call an egm, probably today, demanding the immediate removal of the plc board.

 

Rangers fan groups have united to condemn the move to use the club’s main assets as security and last night investor Kieran Prior stepped forward and asked: “What are the board trying to hide?”

 

Sales Shark owner Brian Kennedy, who was refused security against Ibrox in November when he offered £3 million of emergency funding, has also called on Ashley to clarify his position.

 

Kennedy planned to put the stadium into a trust, but Ashley has made no such promise amid fears he could leaseback the stadium, adding to the lucrative retail contracts he has already negotiated for Sports Direct.

 

Kennedy said: “Without this kind of guarantee I can completely understand the reaction of fans. They are being treated with absolute contempt.”

 

Rangers supporters have been urged to gather outside the main door at Ibrox at 7pm to voice their anger and not enter the stadium for the vital league game that could see Hearts disappear over the horizon in the race for the championship.

 

Chris Graham of the Union of Fans said: “The only people who can stop this now are the fans. We ask them to come to the ground tomorrow night, 45 minutes before kick-off, and stage a mass demonstration at the front door of our Ibrox home.

 

“We would ask fans not to enter the game but if they feel they have to, in order to support the team in an important game, then we would ask them to make their feelings known.

 

“It is time for the fans to make their voices heard in the strongest possible terms, but we must do so together and we cannot waiver.”

 

Rangers chairman David Somers claimed last summer that Ibrox and Murray Park were not up for grabs, but he is now being ridiculed as the club’s Supporters Trust also considers legal action against the board.

 

Somers told Record Sport on July 30: “There is a great deal of nonsense being written about possible sales of Rangers assets. The board has never discussed the sale and/or leaseback of any Rangers asset. Nor do I expect us to do so.

 

“Our mindset is to protect and enhance all the assets of the club for the benefit of future generations of fans and shareholders alike.”

 

The Rangers Supporters Trust have also hit out at the latest move from their board and are seeking legal and political advice on the next steps.

 

A spokesman said: “We believe the board may be acting illegally on two fronts and will be working with any other shareholder who wishes to challenge this.

 

“Quite frankly, this latest move by the board is legalised theft and we will not stand by and watch it happen. If necessary we will instigate legal action against the directors both collectively and individually.

 

“We will be seeking political and government support to stop this attempted asset grab.”

 

Fellow fan ownership group Rangers First added: “We are extremely concerned one party has been granted advance notice of security over assets including our stadium and Auchenhowie at a time when the company which owns our club has assured shareholders it is currently considering various proposals.”

 

Such is the disgust felt by Rangers fans, further boycotts could be organised between now and the end of the season which could hit the club, and Ashley’s retail deals, hard.

 

Shareholder Prior is disgusted the board are considering handing over Ibrox and Murray Park to Ashley and fears unknown events behind the scenes could be prompting the latest moves.

 

He said: “Rangers have credible investors waiting in the wings who can galvanise fans and take the club back to the top, playing in front of full houses again.

 

“This latest move is outrageous and insulting to anyone who has ever played for Rangers or paid to watch the team at Ibrox.

 

“There are other options out there - the Three Bears, Dave King. Why didn’t they engage with Robert Sarver? If they are so desperate for money, why not open it to others?

 

“What has gone on in the recent past? What have this board got to hide? Are there skeletons in the cupboard they don’t want us to know about?

 

“It seems people running the club in recent times all have links to Mike Ashley in one way or another. They have done everything they want him to do, from retail deals to naming rights for the stadium.

 

“He’s holding the club to ransom and this board are absolutely operating in favour of one shareholder about the best interests of all shareholders in the company.

 

“Ibrox has been a bastion of Scottish and European football for over a century. The board are acting foolishly, petulantly and not in the interests of the club or the fans. It’s an absolute disgrace Ashley is being allowed to hold the club over a barrel.

 

“Rangers is being portrayed as a distressed asset only to protect those at the club, who are all acting on behalf of Ashley to protect their own backs.”

 

King and the Three Bears were remaining tight-lipped last night as they consider their next move, although both parties were involved in frantic discussions with lawyers and advisors throughout the day.

 

Rangers said: “The directors confirm they are currently considering various proposals to secure the financial future of the club, however no decision has been made at this time.”

It would appear that the forms submitted to the land registry were approved by Leach and Llambias ONLY and without board approval or NOMAD agreement

 

For those who missed earlier post, Imran Ahmad was at the London offices of WH Ireland yesterday.

 

This is fast becoming the carve up I always feared.
