If Whyte hadn't been allowed to appoint Duff & Phelps as administrators and we had gotten BDO appointed instead, they would have made a much better job of our administration. Structural change wont matter though - it is the same entity. The only way the SFA would avoid being sued in this instance would be if they created a new entity, and that would take them time, time which would allow BDO to get their claim in first. This one has certainly now got interesting. And Zappa, if BDO had been the original administrators we wouldn't be in a newco/oldco situation right now - they would have got it sorted professionally and efficiently.
