ASA confirms one complainant seeks Independent Review of Rangers ‘Scotland’s most successful club’ ruling

 

 

 

Following Wednesday’s announcement that the ASA would not be upholding complaints made against Rangers ‘Scotland’s most successful club’ campaign, a request for an independent review has been recieved.

 

The advertising body has revealed to The Drum that one of the complainants is now seeking an Independent Review of the decision which was confirmed on Wednesday after a total of 78 complaints were lodged against the club’s promotional activity, which included an email campaign reading “Join Scotland’s Most Successful Club at Ibrox’. The campaign also included a radio ad stating: “Join Scotland’s most successful club at Ibrox and guarantee your seat for the last four games of the season…”.

 

The ASA accepted Rangers evidence that the previous club, which entered administration in February 2012, had its assets bought by another company – Rangers Football Club. Adding that it considered consumers would understand the claim was related to Rangers Football Club, rather than whoever owned or operated it.

 

The ASA ruling concluded "that it was not misleading for the ad to make reference to RFC's history, which was separate to that of Newco".

 

Under the terms of an Independent Review both sides have 21 days from the date on the ASA’s letter of notification regarding the decision to ask Sir Hayden Phillips, independent reviewer of ASA adjudications, to review the case.

 

In order to have the case reviewed the person appealing the decision needs to show a “substantial flaw of process or adjudication is apparent” or “show that additional relevant evidence is available”.

 

It is thought that a number of the original complaints were made by fans of rival club Celtic as part of a co-ordinated campaign claiming the use of the club's historic success was misleading as the current iteration of Rangers was only established in 2012.

 

It is not known at this time whether or not the independent reviewer will be taking up the complainant’s request.

 

The reviewer will now decide to accept or reject the request and if accepted ask Rangers to submit further comment. At the conclusion of the investigation the independent reviewer will make a recommendation to the ASA Council which may ask the Council to reconsider the ruling.

NB: Paul Brennan of Celtic Quick News has more or less confirmed that it was him complaining and asking for the review.

His argument is that ASA didn't consult UEFA, who - he says - have the final decision about whether we are the same club.

 

In truth, of course, they don't and aren't going to argue with the SFA anway. Brennan (and his TSFM mates) has/have adopted a very specific interpretation of on of UEFA's licensing rules which they've convinced themselves mean UEFA regard us as a new club.

 

In fact the rule says nothing of the kind - it simply amounts to a penalty for an insolvency event - but Brennan knows best, of course (just like he did on the FTT and the SPL commission.)

 

A review based on the statement that the ASA did not consult with UEFA is doesn't amount to the provision of new evidence, nor does it show a substantial flaw of process, so it'll almost certainly not even get to the consideration stage.

 

Of course Brennan can't be wrong, so that rejection will undoubtedly just be another part of the establishment conspiracy (just like the FTT judges, Lord Nimmo-Smith, Lord Hodge, Lord Glennie etc)

 

Brennan's state of mind is such that there is no result which will change his world view. Whatever the result, it will simply validate his position in his mind.

 

RFC lose (which isn't going to happen) ----> we're a new club

RFC win ---------------------------------> we're a new club and it's yet more evidence that the establishment is covering that up.

Wouldn't be surprised if Brennan's marshalling a lot of this.

Along with Mad;Joe; and the taxi driver, they are serious sickos. They really do deserve to be well and truly outed and face up to some very public debates. In other words, made out to be the laughing stock that they are.

Time is long overdue to take these psychopaths to the cleaners and show the world what they're like and what they've done.

Deary me!, just shows how desperate these bigots are to keep chasing the likes of this. If they spent as much time and effort actually supporting their own team instead of obsessing over us then maybe they could challenge us on the attendances!,however it seems Rangers play such a big part in their sorry lives that they forget to go to the piggery.
