The only legitimate reason to believe that newco Rangers should be refused admittance is if the other SPL clubs reasonably believed that (1) Rangers will lose the BTC and (2) that in losing it, it will be ruled that they actually did something wrong, and didnâ??t just make a mistake, made in good faith.

 

The problem for the SPL clubs, if they want to be honest and show integrity, is that they will not know the outcome of the BTC before the vote, and even then wonâ??t know if that outcome includes a conclusion of wrongdoing or innocent error.

 

So what can they do? If I was an SPL chairman, Iâ??d put forward a proposal to allow newco Rangers to join on the basis that at the time of the vote they had not been found guilty of wrongdoing. But with a condition that if the EBT case was ruled to be taxable and if it was held that Rangers did do wrong (in comparison to just making honest mistakes) then they would be automatically relegated at the season end in Div 1. If I was representing Rangers, this is what Iâ??d argue for.

 

I don't see that the two things are related.

 

Whether the EBT scheme is/was is not relevant to Newco Rangers.

 

The simple fact is that the SPL Clubs have the right to accept or reject an application for the transfer of a share to a newco and the only REAL consideration in that regard should be - is newco a viable company?

 

I agree with most of the analysis about the reasons for the administration and subsequent liquidation of oldco but sadly they are history.

 

You can argue about "sporting integrity" until you are BLUE in the face but once again that has NOTHING to do with newco.

 

One of the big problems about finding a resolution to this mess is the two league system; if there had been one league body then there may well have been a rule about relegation in the event of "an insolvency event" but one thing is sure, there will be in future!

Agreed 100% they have that right.

But equally, no one, apart from the Club and the SFL has the right to negotiate a way in to the SFL 1st Division for us. Even more so if it involves negotiating a SKY/ESPN deal.

I would agree if there is a new structure in place, but there isn't.

In theory you are correct, they don't have the right but....

 

I'll answer that by quoting form my reply to BD on the "Reconstruction" thread:

 

There are three reasons:

 

1.The SFA have been pushing their 5-point plan including: one league, play-offs, more even distribution of the monies etc for a year but hadn't made any siginificant progress. The SPL were the stumbling block, as I can attest from discussions with Mr Doncaster on behalf of Supporters Direct* own similar Fans' Plan.

 

2.The need to be seen to "punish" Rangers rightly or wrongly for "perceived" wrongdoings.

 

3.The need not to lose the TV money in the process.

 

I think most people now concede that the "right" answer is that we apply and are accepted to SFL3 but this is by no means guaranteed and at the same time knocks out the TV deal and doesn't advance the reconstruction process.

 

Hence the "negotiated" settlement.

 

Frankly if we get away with Division 1, we'll have won a watch.
