Walterbear, the Supreme Court will trudge to its own decision on the basis of the submissions made at the appeal hearing. Neither side made any argument that depended on the outcome of the case against Whyte.

I can't see any connection myself but if there had been the SC would have continued the appeal to hear further submissions from Counsel.
