I'm of the opinion that our present travails have merely masked his inadequacies as manager. An opinion forged in such places as Falkirk,Malmo,Maribor and in particular Motherwell, the decision that day was one of the most bizarre I've ever seen, two left backs on the park neither of them playing left back instead he exposes Ross Perry to a half decent,tricky, pacey winger ensuring Perry has the proverbial piss ripped out of him by the winger till McCoist finally wakens up and changes it.

Thing is if we were to exit administration via a CVA then we will have discharged our tax liabilities to the satisfaction of HMRC just the same way they satisfied HMRC of their liability. -
It makes as much sense to the creditors as the money contingent on Champions League participation which was roundly trashed by Whytehouse, how any sane mind can think Duff & Phelps are not working to an agenda is beyond me. Perhaps they will rue the day they f*&ked over Brian Kennedy.

Collyer Bristows' are not contesting the right to the £3.8m (or thereabouts) our only live claim against Collyer Bristow is the £25m, as far as I'm aware the three parties with a claim on the £3.8m (or thereabouts) is HMRC, Merchant Turnaround (£1m), Jerome Pension Trustees (£2.9m) I'm led to believe the odds favour the latter two.

The last thing on this planet that Duff & Phelps want to happen is RFC plc exiting administration via CVA. The for sale brochure that they did was 17 pages long and had 16 pages on a newco scenario and one on a CVA! (iirc). The litigation aspect is where Duff & Phelps have been quite clever (when you consider who their master is!) far being it the monies you state Zappa, the relity is that they withdrew the claim of RFC plc. I'm pretty certain that the monies will find its' way to the Jerome Pension Trustees which is basically a front for the Whyte and Earley owned Worthington Group. The big £25m case against Collyer Bristow will die when RFC plc gets liquidated. Anyway Duff & Phelps are being disingenuous at best because all monies would go into the CVA in any case. Duff & Phelps are just using up time till their purpose is served.

If a CVA isn't achieved before the start of the season then the punishment would just be the bog standard 10 point deduction (?) then what is to be gained going newco rather than spending a few extra weeks/months in administration ergo avoiding potential newco sanctions (if in fact there are any save the UEFA 3 year exclusion)? -

I'm led to believe that it's just a vehicle for holding the 85.3% shareholding the same way Murray Sports and Wavetower held the shareholdings, apparently more convenient than divvying up the shareholding between each individual investor.

Careful now some on here simply cannot comprehend that people can be privy to information that they're not. In PMs' defence regarding your OP and the £28m, I don't think the circumstances then and now means you're comparing apples with apples. The £28m (I always thought it was £25m but that's irrelevant I suppose) wasn't an offer to buy the club from David Murray for that sum it was an offer to recapitalise the club to the tune of that amount. The £28m then was going into the club, if someone were to offer £28m today it wouldn't go to the club but into the CVA pot, the club would still require to be recapitalised post CVA. Having said that I have to agree that I too have had major reservations of the strategy of their bid, some aspects have left me simply bewildered and the temptation to say "just put your money on the f*&king table and cut out the crap" is a big one, but I suppose that's easy to say as I'm not wearing their shoes. To let our club slip into God knows whose hand for the sake of £million here or there would be an act of great folly. I do not think anybody could have devised such a torturous scenario for f*&king with bears minds. I just want my club to saved, preferably by CVA but that hope seems to be ebbing away at an alarming rate.
