PB status does NOT rule out another bidder coming in after the period of exclusivity is over, though it is unlikely BK/K could now push a takeover through. BUT - Whyte's shares need to be delivered for a CVA to work. Kennedy is obviously trying to buy them off him so he can present Miller with them to get the CVA.
